Privacy policy
Last updated: October 24, 2026. This policy explains what Merch FinTech LLC collects, why, who sees it and what you can do about it. Questions go to hello@merchfintech.com.
Plain-English summary. We collect what we need to run your account and process your payments: contact and business details, the information our sponsor-bank processing partners require to underwrite you, and the transaction data that flows through the platform. We share it with the partners who deliver the service and with no one else except as the law requires. We do not sell your personal information. Your customers' data belongs to you; we process it on your behalf and you can export it at any time. This summary does not replace the policy below.
1. Who we are and what this covers
Merch FinTech LLC ("Merch FinTech", "we", "us") is a Florida limited liability company with offices in Florida and New York. This policy covers merchfintech.com, our vertical brand sites including 613OS and LiceHQ unless a site posts its own notice, and the services we provide: payment processing arranged through our sponsor-bank and processor partners, software subscriptions and custom builds, our partner and ISV programs, and the business banking, card and payroll products provided through our partner institutions and providers. It applies to visitors, applicants, customers, partners and the people who use our software through them.
Where we process information about your customers, members, students or donors inside the platform, we act as your service provider. You decide what is collected and why; this policy describes how we handle it for you.
2. Information we collect
Information you give us. Name, business name, email, phone and address when you request a quote, send a statement, ask about a product or apply. If you apply for a merchant account, the information our sponsor-bank processing partners require to underwrite you: ownership details, date of birth, government identification, tax identification numbers, bank account details for settlement and processing history. Statements you send us for comparison. Messages you exchange with our team.
Information collected automatically. Device type, browser, IP address, pages viewed, referring page and the cookies described in our cookie policy. Inside the platform, logs of actions taken in your account for security and support.
Information from partners. Identity and fraud-screening results, credit and risk information our processing and banking partners return during underwriting and on an ongoing basis, and the merchant data a referring partner or reseller provides when you come to us through them.
Transaction and customer data. When you accept a payment, send an invoice, book an appointment or text a client, the platform records the transaction amount, method, status and the customer details you entered. Full card numbers are tokenized by our processing partners; we do not store them on our systems.
3. How we use information
- To provide the services: open and maintain your account, process and settle payments, run the software, deliver messages and AI features, and support you.
- To underwrite and monitor accounts, verify identity, prevent fraud and meet card-network, sponsor-bank and legal obligations, including anti-money-laundering rules.
- To bill you, including the usage wallet for messaging, calls and AI, and to pay partners and ISVs their residuals.
- To prepare quotes and statement comparisons you ask for.
- To improve the platform, fix problems and measure what is used.
- To send service notices, and marketing you can opt out of at any time.
4. Payments, banking and cards
Each business holds its own merchant account with our sponsor-bank processing partners; Merch FinTech is the referring agent. Those partners and the card networks process your application and transaction data under their own privacy notices and rules, which we will point you to on request. Business banking, expense cards, gift cards and stored-value cards are provided through our partner bank, and payroll through our payroll partner, each subject to approval and under its own account agreement and privacy notice, which you receive when you apply. An inquiry on our site shares only the details you enter with us; the application itself is a separate step with that partner, and we share with the partner what it needs to process it.
5. Messaging, calls and AI features
The platform sends texts, emails, WhatsApp messages and calls on your instruction, including through the AI receptionist and workflows you configure. You are responsible for obtaining the consents the law requires from the people you contact and for honoring opt-outs; our acceptable use policy sets the rules. AI features are delivered with third-party model providers who process the content only to provide the service to us. We do not sell your customers' data, and we do not use it to market to your customers.
6. How we share information
- With our sponsor-bank and processor partners, card networks and gateway providers, and with our partner bank and payroll provider, to deliver the services and meet their rules.
- With service providers who host, store, send, analyze or support the platform on our behalf, under contracts that limit their use to our instructions.
- With the partner or reseller through whom you joined, to the extent needed for their support, billing and residual statements.
- With referral partners for lending, merchant funding or payroll, only when you ask to be introduced.
- To comply with law, subpoenas and regulators; to enforce our terms; to protect the rights, property and safety of Merch FinTech, our customers and others.
- In a merger, acquisition or sale of assets, in which case this policy continues to apply to the information transferred.
We do not sell personal information for money, and we do not share it for cross-context behavioral advertising.
7. Your data, export and retention
Your contacts, invoices, transaction history, schedules and content are yours. You can export them from the platform or request an export from us, during your subscription and for 30 days after it ends. We keep account, transaction and underwriting records for as long as the law, tax rules and card-network requirements demand, generally seven years for financial records, and delete or anonymize the rest when it is no longer needed.
8. Security
We use administrative, technical and physical safeguards appropriate to the information we hold, including encryption in transit and at rest, tokenization of card data by our processing partners, role-based access and logging. No system is perfectly secure; if a breach affects your information we will notify you as the law requires. See our security page for more.
9. Your choices and rights
You can update your account details in the platform, unsubscribe from marketing email with the link in any message, reply STOP to any text, and manage cookies in your browser. Depending on where you live, you may have the right to access, correct, delete or receive a copy of your personal information, to restrict or object to certain processing, and to appeal a decision we make about a request. Write to hello@merchfintech.com with "Privacy request" in the subject; we verify your identity before acting and respond within the time the law allows. We will not treat you differently for exercising a right. Requests about data we hold as your service provider are directed to the business that collected it.
10. Children
Our services are for businesses and organizations and are not directed to children under 13. Schools, camps and similar institutions may hold records about minors inside the platform; they are the controllers of that information and we process it only on their instructions.
11. Where data is processed
We are based in the United States and process information there. If you use the services from elsewhere, you consent to processing in the United States.
12. Changes and contact
We may update this policy and will post the new date at the top. Material changes to how we use information you have already given us will be announced in the platform or by email before they take effect.
